FERPA Information

The Family Educational Rights and Privacy Act of 1974, commonly referred to as FERPA or the Buckley Amendment, is a federal law designed to protect the privacy of a student’s education record. As Mohave Community College (MCC) is an educational institution that receives federal funding for programs administered by the US Secretary of Education, FERPA applies to MCC education records. FERPA grants adult students (18 and older) the following rights:

  • The right to inspect and review their education records
  • The right to seek the amendment of their education records
  • The right to consent to the disclosure of their education records
  • The right to prevent disclosure of their education records
  • The right to obtain a copy of their school’s Student Records Policy
  • The right to file a complaint with the FERPA Office in Washington, D.C.

Education Records

Excluding certain exceptions set forth in FERPA, commonly referred to as Directory Information, Mohave Community College will not provide personally identifiable student information to third parties without the student’s signed, written consent aside from some exceptions (Please see “Who has Access to Protected Education Records?” below for more information). Education records include, but are not limited to:

  • admissions information for students who are accepted and enrolled
  • biographical information including date of birth, gender, nationality, race, ethnicity, and identification documents
  • communications in written, emailed, or recorded form that are part of the academic process or pertain to a student’s status
  • course work including papers, exams, grades, and evaluations
  • disciplinary records
  • internship program records
  • personal information shared through course assignments, class discussions, evaluations, and office hour visits
  • student financial and financial aid records
  • student status details such as academic specialization and activities, class schedules, and courses taken

Directory Information

At Mohave Community College, directory information includes the following:

  • Name
  • Mailing Address
  • Institutional E-mail Address
  • Phone Numbers
  • Photographs
  • Most recent previous school attended
  • MCC ID Number
  • Major field of study
  • Campus attended
  • Status (e.g., in-state/out-of-state status, current enrollment, dates of attendance, full-time/part-time, withdrawn, degrees awarded)
  • Honors received (e.g., Dean’s List, Honors List, PTK)
  • Participation in activities and sports
  • Weight and height of athletic team members

FERPA Release and FERPA Block

A student may grant MCC permission to release authorized information to a third party by assigning a FERPA Release Relationship. Third parties include, but are not limited to: parents, spouses, and third-party sponsors. To access this option, please go to the MCC Colleague Self-Service and select User Options on the left. You will see a Student Records Release option where a FERPA Release Relationship may be added. This relationship remains active indefinitely unless the student chooses to deactivate it, an option accessed on the same page.

A student may request to prevent any of their education records, even that identified as directory information, from being disclosed to a third party except in cases where the third party has a legitimate educational interest or other exceptions noted below by applying a FERPA Block. To access this option, please go to the MCC Colleague Self-Service and select User Options on the left. You will see a Student Records Release option where a “Deny Access to All” option is located. Please note that selecting this option will deactivate any current FERPA Release Relationships and will prevent the submission of new ones. This block can be rescinded by deselecting the “Deny Access to All” option, but any deactivated releases would need to be reactivated by adding the relationship again. This block remains active indefinitely unless the student chooses to deactivate it.

Who has Access to Protected Education Records?

At Mohave Community College, parties that have access to protected education records are as follows:

  • School employees who have a “legitimate educational interest” in the records to perform their duties
  • Other schools where a student seeks to enroll or is enrolled
  • Accrediting organizations
  • Organizations doing certain studies for or on behalf of the School
  • Appropriate parties to determine eligibility, amount, or conditions of financial aid, or to enforce the terms and conditions of aid
  • Certain government officials of the US Department of Education, the Comptroller General, and state and local educational authorities, in connection with an audit, authorized representatives of the US Attorney General for law enforcement purposes, or state or federally supported education programs
  • Individuals who have obtained a judicial order or subpoena
  • School officials who have a need to know concerning disciplinary action taken against a student
  • Appropriate parties who need to know in cases of health and safety emergencies when necessary to protect the student and/or others
  • An alleged victim of a crime of violence or non-forcible sexual offense has a right to learn the results of a disciplinary proceeding conducted by the institution against the alleged perpetrator of the crime
  • Information regarding any violation of School policy or state, federal or local law, governing the use or possession of alcohol or a controlled substance may be released to the parents or legal guardian of a student under the age of 21

Note: FERPA allows for disclosure in the above circumstances, but disclosure is not required.

Solomon Amendment

The Solomon Amendment is a federal law that requires institutions receiving certain federal agency funding to fulfill military recruitment requests for access to campus and for lists containing student recruiting information. It provides branches of the military access to certain student information which would have been denied them under the Family Educational Rights and Privacy Act (FERPA).

Recruiters may receive “student recruiting information” for either the immediately previous, current or future term for all students, aged 17 and older, who are/were registered for at least 1 credit hour in the requested semester/term. If a request is received between terms, the recruiter and registrar will determine from which term the information is preferred. Student recruitment information includes:

  • Names
  • Addresses
  • Institutional E-mail Address
  • Phone Numbers
  • Date of Birth
  • Age
  • Levels of Education
  • Academic Majors
  • Degrees Received
  • The most recent educational institution enrolled in by the student
