What is Proposition 308?

Prop. 308 makes two significant changes to Arizona law. First, non-citizen students—with exceptions as defined by law**—are eligible for in-state resident tuition if the student has both:

a) attended a high school in Arizona for a minimum of two years

b) graduated from a public school, private high school, or homeschool in Arizona, or earned a GED in Arizona.

Prop. 308 repealed A.R.S. § 15-1825, and now eligible non-citizen students can receive financial aid funded in whole, or in part, with state monies.

When does Proposition 308 go into effect?

It became effective on December 5, 2022, after Governor Doug Ducey signed it into law.

Who benefits from Proposition 308?

Non-citizen students** are eligible for in-state resident tuition if the student:

a) attended a high school in Arizona for a minimum of two years

b) graduated from a public high school, private high school, or homeschool in Arizona, or earned a GED in Arizona.

I’m on a visa. Do I qualify?

The college must determine if your visa status can be eligible based on current administrative regulations, as many visa types (including F1, F2, J1, H4, or H1) are not eligible.

If you are currently on a visa or seeking an adjustment of status, talk to someone in the Admissions office.

What if I am taking Dual Enrollment courses or participating in an early college program?

Dual Enrollment and early college non-citizen students do not qualify while still attending high school. The good news is once you graduate from high school, you will be eligible if you meet the criteria.

When will in-state tuition be reflected?

This rate will be applied to all courses starting in the Spring 2022-2023 semester. If you’ve already registered for Spring 2022-2023 classes and are eligible, we will update your tuition before the start of the semester. If you’ve enrolled in a payment plan, that will automatically update based on the new balance due. Check your email regularly for updates from Mohave Community College.

Should I wait to register until January 2023?

Register for classes now to get your courses. If you meet the eligibility criteria, we will adjust your tuition before the start of the semester. If you’re on a payment plan, we will also adjust it.

Am I eligible for any financial aid?

While you do not qualify for federal aid as a non-citizen student, you may be eligible for state and local financial assistance through grants, scholarships, or tuition waiver programs. Talk to someone in the Financial Aid office for more information.

What information do I need to provide for in-state tuition?

Beyond valid identification, you will need to provide your official Arizona high school and/or GED transcript showing your attendance for two years and graduation. We will use high school transcripts if we already have them on file and can use unofficial transcripts to set conditional in-state resident tuition rates.

How do I request my high school/GED transcripts?

Please reach out to your high school to request transcripts. If you need to request GED transcripts, please reach out to the Arizona Department of Education. Please have these transcripts sent to the Registrar’s Office via mail or email to the below address directly from the institution to the College. Any transcripts received by the student will be treated as unofficial.

Do the two years of physical presence in Arizona while attending high school need to be
consecutive?

No. Students do not need to have two years of consecutive presence. However, to be eligible,
they still must provide documentation that they both:

1. Attended any public or private high school option or homeschool equivalent while physically
present in Arizona for at least two years

2. Graduated from a public or private high school option or homeschool equivalent or obtained a
high school equivalency diploma in Arizona.

Do the qualifying non-citizen students eligible for in-state tuition under Prop. 308 also need
to prove domicile under A.R.S. § 15-1802?

No. A qualifying non-citizen student will pay in-state tuition if they meet the requirements of
A.R.S. § 15-1803(B):

1. The student attended any public or private high school or homeschool equivalent while
physically present in Arizona for at least two years

2. The student graduated from any public or private high school or homeschool equivalent in
Arizona or obtained a high school equivalency diploma in Arizona (e.g., a GED).
